The terms governing your use of our services.
By accessing or using our website, mobile applications, and related services (collectively, the "Services"), you agree to be bound by these Terms and Conditions. If you do not agree to these terms, you may not access or use our Services. These terms apply to all visitors, users, and others who access or use the Services.
We may update these terms from time to time. We will notify you of material changes by posting the updated terms on this page and updating the "Last updated" date. Your continued use of the Services after such changes constitutes your acceptance of the new terms. We encourage you to review these terms periodically.
You may use our Services only for lawful purposes and in accordance with these terms. You agree not to use the Services in any way that violates applicable laws or regulations, infringes the rights of others, or could harm, disable, or overburden our systems or networks.
You agree not to attempt to gain unauthorized access to any part of the Services, other accounts, or any systems or networks connected to the Services. You may not use the Services to transmit any viruses, malware, or other harmful code, or to collect or harvest personal information about other users without their consent. We reserve the right to suspend or terminate your access if we believe you have violated these terms.
Certain features of the Services may require you to create an account. You agree to provide accurate, current, and complete information during registration and to update such information as needed. You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account.
You must notify us immediately of any unauthorized use of your account or any other breach of security. We are not liable for any loss or damage arising from your failure to protect your account credentials or from unauthorized use of your account.
The Services and their entire contents, features, and functionality (including but not limited to text, graphics, logos, icons, images, and software) are owned by us or our licensors and are protected by copyright, trademark, and other intellectual property laws. You may not copy, modify, distribute, sell, or create derivative works based on our Services or content without our prior written consent.
You retain ownership of any content you submit through the Services. By submitting content, you grant us a non-exclusive, royalty-free, worldwide license to use, store, display, and process that content as necessary to provide and improve the Services and as described in our Privacy Policy.
Your use of the Services is also governed by our Privacy Policy, which describes how we collect, use, and protect your personal information. By using the Services, you consent to the collection and use of your information as described in the Privacy Policy. Please review our Privacy Policy carefully.
The Services are provided "as is" and "as available" without warranties of any kind, either express or implied. We do not warrant that the Services will be uninterrupted, error-free, or free of harmful components. We do not guarantee the accuracy, completeness, or usefulness of any information on the Services.
The Services may contain health-related information for general educational purposes only. This information is not a substitute for professional medical advice, diagnosis, or treatment. Always seek the advice of your physician or other qualified health provider with any questions you may have regarding a medical condition. Never disregard professional medical advice or delay seeking it because of something you have read on our Services.
All professional medical services are provided by licensed physicians and clinicians affiliated with independently owned and operated professional practices. The Stack provides administrative and technology services to affiliated medical practices it supports, and does not provide any professional medical services itself. The Stack is not a medical provider and does not prescribe, dispense, or ship medications. All prescribing and clinical decision-making are made solely by licensed medical professionals, and medication fulfillment is handled by licensed pharmacies when prescribed.
To the fullest extent permitted by applicable law, we and our officers, directors, employees, and agents shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits, data, or goodwill, arising out of or in connection with your use of (or inability to use) the Services, even if we have been advised of the possibility of such damages.
In no event shall our total liability to you for all claims arising out of or related to the Services exceed the amount you paid to us, if any, in the twelve (12) months preceding the claim, or one hundred dollars ($100), whichever is greater. Some jurisdictions do not allow the exclusion or limitation of certain damages, so some of the above may not apply to you.
You agree to indemnify, defend, and hold harmless us and our officers, directors, employees, agents, and affiliates from and against any claims, liabilities, damages, losses, costs, or expenses (including reasonable attorneys' fees) arising out of or related to your use of the Services, your violation of these terms, your violation of any rights of another, or any content you submit through the Services.
We may suspend or terminate your access to the Services at any time, with or without cause or notice, including if we believe you have violated these terms. Upon termination, your right to use the Services will immediately cease. Provisions of these terms that by their nature should survive termination shall survive, including ownership provisions, disclaimers, indemnity, and limitations of liability.
You may stop using the Services at any time. If you wish to delete your account, you may do so through your account settings or by contacting us. We may retain certain information as required by law or for legitimate business purposes.
These terms shall be governed by and construed in accordance with the laws of the State of California, United States, without regard to its conflict of law provisions. Any dispute arising out of or relating to these terms or the Services shall be resolved exclusively in the state or federal courts located in California, and you consent to the personal jurisdiction of such courts.
You agree that any dispute resolution proceedings will be conducted only on an individual basis and not in a class, consolidated, or representative action. If any provision of these terms is held to be invalid or unenforceable, the remaining provisions will remain in full force and effect.
We may modify these terms at any time. We will post the updated terms on this page and indicate the date of the last revision. For material changes, we may provide additional notice such as an email or an in-Service notification. Your continued use of the Services after the effective date of any changes constitutes your acceptance of the revised terms.
